Fees

As a Florida probate attorney, I provide legal services for a flat fee as opposed to a percentage of the estate, or billing on an hourly basis. The benefit to a prospective client is that they will know the attorney's fees upfront and it eliminates the client's concern of hiring an attorney only to be billed each time they call or email with a question.

As an example, an estate worth $500,000 with one asset, one beneficiary, and no creditors may involve no more work than an estate worth $50,000 with the same details, and my flat fee based on the facts of the case would probably be much lower than if I charged $15,000 (the 3% Florida probate attorney fee that is presumed reasonable under state law). A flat fee is based on the amount of work involved, regardless of the value of the estate.

While this approach may involve a little more time up front, the outcome is that you’ll have a firm fee quote from a Florida probate attorney, at no charge, and with no obligation to move forward.

The following is a general list of the information required to provide a flat fee quote.  You can provide this information by calling me or you can email your responses to me here.  Email is often the best form of contact as I can provide you with a written response or additional questions, and you won't have to take notes during a phone call.

1.     What is the decedent’s name, date of death and in which county and state did the decedent die a resident of?

2.     Did the decedent have a will? If so, what is the location of the original (not a photocopy) and can you provide me with a copy to review to see if it qualifies in Florida and was properly executed? You can email or fax the will to me at (352) 726-6117.

3.     Has the decedent’s estate already been opened in any probate court anywhere to date?

4.     Was the decedent survived by a spouse and children? If so, please list the heirs and their relationship to the 
decedent. Please include deceased children and whether any deceased children have surviving children.

5.     Are any of the beneficiaries of the estate minors (under the age 18)?

6.     Do you anticipate any contested matters, either by creditors, beneficiaries, family members or others?

7.     Describe types of assets and approximate values that may require probate.

8.     Does the decedent have any unpaid creditors? If so what is the nature of the debt (i.e. credit card, Medicaid,   
mortgage, car loan, medical, taxes, etc.) and the approximate amount of the debt.
